Definitions
Collective Bargaining: Collective bargaining consists of negotiations between an
employer and a group of employees that determine the conditions of employment. Labor Union: An organization of wage earners formed for the purpose of serving the members' interests with respect to wages and working conditions.
Collective Agreement: A contract between labor and management governing wages and benefits and working conditions.
Yellow Dog Contract: An employment contract in which the employer forbids the employee to join a labor union. Yellow-dog contracts are not legally enforceable.
At-will: Under common-law, this phrase describes the relationship between employer and employee that exists without a written contract or other agreement guaranteeing job security. An at-will employee may be terminated at the will of the employer without reason or cause.
Fair Share: Under a union security clause of a union contract, the amount a nonunion member must contribute to a union to support collective bargaining activities. This arrangement is justified on the grounds that the union is obliged to represent all employees faithfully.
Grievance: A dispute arising between the employer and one or more employees or the union.
Weingarten Rights: 1974 U.S. Supreme Court decision (420 US 251) which ruled that an employee has the right to a co-worker or union representative in any interview the employer might hold that is intended to investigate a possible discipline charge against the employee.
